1. Acceptance of Terms

By accessing and using ScopeSketch ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

ScopeSketch is a web application that helps developers, freelancers, and agencies transform project ideas into structured, professional project scopes using artificial intelligence. The service includes:

  • AI-powered project scope generation
  • PDF and Markdown export capabilities
  • Project management and storage
  • Structured scope editing tools
  • Usage tracking and plan management

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Maintain the security and confidentiality of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Billing

4.1 Plan Types

ScopeSketch offers the following plans:

  • Free Plan: Limited features with usage restrictions
  • Pro Plan ($9.00 one-time): Full feature access with expanded limits
  • Add-on Packs: Additional scope generations (+5 scopes: $3.00, +10 scopes: $5.00)

4.2 Payment Terms

  • Pro Plan purchases are one-time payments providing lifetime access
  • Add-on packs are one-time purchases that never expire
  • All payments are processed securely through Stripe
  • Prices are in USD and include all applicable fees
  • Payment must be received before service activation

4.3 Refunds

Due to the digital nature of our service and immediate access upon purchase, all sales are final. However, we may provide refunds at our sole discretion in cases of:

  • Technical issues preventing service access
  • Billing errors or duplicate charges
  • Service unavailability for extended periods

5. Usage Limits and Fair Use

Your use of the Service is subject to usage limits based on your subscription plan:

  • Free Plan: 2 AI generations total, then upgrade required
  • Pro Plan: 5 AI generations included, unlimited daily usage, additional add-on packs available
  • Add-on Packs: Additional generations that never expire

You agree not to abuse or circumvent these limits through multiple accounts, automated tools, or other unauthorized means.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, or defamatory
  • Infringe upon intellectual property rights of others
  • Transmit spam, malware, or other malicious content
  • Reverse engineer, decompile, or attempt to extract source code
  • Use automated tools to access the Service beyond normal usage
  • Resell or redistribute the Service without authorization

7. Intellectual Property Rights

7.1 Service Content

The Service, including its design, code, features, and documentation, is owned by ScopeSketch and protected by copyright, trademark, and other intellectual property laws.

7.2 User-Generated Content

You retain ownership of content you input into the Service. However, you grant us a limited license to process, store, and transmit your content solely to provide the Service.

7.3 AI-Generated Content

Content generated by our AI system is provided to you for your use. While we don't claim ownership of AI-generated output, you are responsible for ensuring its appropriateness and accuracy.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by ourPrivacy Policy, which is incorporated into these Terms by reference.

9. Service Availability and Modifications

We strive to maintain high service availability but cannot guarantee uninterrupted access. We reserve the right to:

  • Modify or discontinue features with reasonable notice
  • Perform maintenance that may temporarily affect service availability
  • Update these Terms with 30 days advance notice
  • Suspend accounts that violate these Terms

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOPESKETCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless ScopeSketch from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

12.1 Termination by You

You may terminate your account at any time through your profile settings or by contacting us. Termination does not entitle you to a refund of any payments made.

12.2 Termination by Us

We may terminate or suspend your account immediately if you breach these Terms or engage in activities that harm the Service or other users.

12.3 Effect of Termination

Upon termination, your access to the Service will cease, and we may delete your account data after a reasonable grace period.

13. Governing Law and Disputes
